Printing Terms & Conditions

By choosing Rockford Silk Screen for their printing needs, the customer agrees to our terms and conditions as outlined below. If you have any questions about any of these, please feel free to contact us at 888-933-8249.

Estimation

Due to current market price fluctuations, an estimate not accepted within 14 days may be changed. If a material price changes within the 14 days , we will honor the original estimated amount. However, new estimates requested in that timeframe may have different material pricing.

At  RSSP , we work closely with our international suppliers to provide the most cost-effective shipping options possible. However, the exact tariffs and duties are assessed by customs authorities once the shipment arrives in the destination country. These charges may vary depending on the destination and cannot be predicted in advance.

It is the responsibility of the end consumer to pay any and all additional fees, including tariffs and duties, incurred at the time of delivery.

To provide full transparency, we will indicate on the order details if there are any potential additional tariff expenses associated with a specific line item, which may not be included in the order's total cost at checkout.

We strive to minimize additional costs and assist in alleviating unexpected charges where possible, but ultimately, these costs are the responsibility of the recipient.

Color
Because of differences in equipment, substrates, inks, and other conditions between color proofing and production operations, a reasonable variation in color between color proofs and the completed job is to be expected. When a variation of this kind occurs, it will be considered acceptable performance. Rockford Silk Screen Process will always do its best to reasonably color match reprints to prior jobs, but a variation in color may occur due to length of time, machinery, and difficulty of exact color matching. Rockford Silk Screen will manufacture parts based on pleasing color.  If the client requests a color match, additional calibration and approval process will incur additional cost for the client.

Overruns or Underruns

Overruns or under-runs will not exceed (10%) ten percent of the quantity ordered. Rockford Silk Screen Process will bill for actual quantity delivered within this tolerance. If the customer requires a guaranteed quantity, the percentage of tolerance must be stated at the time of quotation. Rockford Silk Screen Process occasionally needs to print a greater amount to achieve the requested amount due to set up, human error, defections and waste. Rather than send the customer defective product or always be under the desired total, the +/- of 10% is set up to best obtain the desired number ordered. If the book total is under the desired amount, the customer will be credited that amount if applicable.

Proofs

Rockford Silk Screen Process will process and email your proof for review and approval. Minor corrections will need to be communicated via email. No changes, corrections, or approvals can be given verbally. Rockford Silk Screen Process will not be responsible for undetected errors in production if a proof is not required by the customer. The customer will be liable for the proofing process and time invested once deciding to use Rockford Silk Screen Process. If the job is canceled for any reason, the customer will incur any proofing and/or design fees. Revisions exceeding three requests due to client changes and not design errors will be billed at the rate of $95/hour.

Terms/Claims/Liens

Unless specified in writing to the contrary, payment is 50% down when the order is placed, and the remaining balance before the product is shipped unless the customer has applied for and been approved for credit terms. Please be advised that, due to order volume, we reserve the right to request a deposit on all orders, even for accounts with established terms. In an effort to help mitigate rising interest rates and keep costs low for our clients, we are introducing a deposit savings plan for all new orders. We are offering a 2.5% discount for accounts with established terms that place a 25% down payment, and a 5% discount for orders with a 50% down payment.

Payments that are not paid within terms are subjected to 1% interest compounded weekly. Claims for defects, damages, or shortages must be made by the customer in writing no later than 10 calendar days after delivery. If no such claim is made, Rockford Silk Screen Process and the customer will understand that the job has been accepted. By accepting the job, the customer acknowledges that Rockford Silk Screen Process’s performance has fully satisfied all terms, conditions, and specifications. Rockford Silk Screen Process’s liability will be limited to the quoted cost of defective goods, without additional liability for special or consequential damages. As security for payment of any sum due under the terms of an agreement, Rockford Silk Screen Process has the right to hold and place a lien on all customer property in Rockford Silk Screen Process’s possession. This right applies even if credit has been extended, notes have been accepted, trade acceptances have been made, or payment has been guaranteed. If payment is not made, the customer is liable for all collection costs incurred.

Accuracy of Specifications

Estimates are based on the accuracy of the specifications provided. Rockford Silk Screen Process can requote a job at time of submission if materials do not conform to the information on which the original estimate was based.

Orders Acceptance

Acceptance of orders is subject to credit approval and contingencies, such as fire, water, strikes, theft, vandalism, acts of God, and other causes beyond Rockford Silk Screen Process’s control. Canceled orders require compensation for incurred costs and related obligations including but not limited to the cost of material purchase, manufacturing costs, shipping costs, and design time.

Experimental Work

Experimental or preliminary work performed at customer’s request will be charged to the customer at provider’s development costs. This work cannot be used without Rockford Silk Screen Process’s written consent.

Artwork/Blueprints

It is the customer’s responsibility to maintain a copy of the original file. Rockford Silk Screen Process is not responsible for digital storage or for accidental damage to media supplied by the customer or for the accuracy of furnished input or promises made about Rockford Silk Screen Process’s ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize customer-supplied files will be charged at prevailing rates.

Alterations/Corrections

Customer alterations include all work performed in addition to the original specifications. All such work will be charged at Rockford Silk Screen Process’s current design rates.

Customers Property

Rockford Silk Screen Process will only maintain fire and extended coverage on property belonging to the customer while the property is in Rockford Silk Screen Process’s possession. Rockford Silk Screen Process’s liability for this property will not exceed the amount recoverable from the insurance.

Delivery

Online portal orders will have shipment cost associated.  Orders outside of online orders will have shipment rates estimated on the sales order, unless shipment details are not to be determined until time of shipment. Rockford Silk Screen Process will charge accordingly at current rates or the customer can arrange pickup and delivery. Charges for delivery of materials and supplies from the customer to Rockford Silk Screen Process, or from the customer’s supplier to Rockford Silk Screen Process are not included in quotations unless specified.

Shipping Charges

If shipping charges are not noted at time of quotation and not arranged using your direct carrier, they will be calculated at time of shipment and added to the total order. Please note that if you require predefined shipping costs, that it must be noted prior to confirming cost and movement to production.

Production Schedules

Production schedules will be established and followed by both the customer and Rockford Silk Screen Process. Rockford Silk Screen Process will do it’s best to meet the client’s timeline request, but are not responsible for manufacturing and supplier delays.  There will be no liability or penalty for delays due to state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authority, acts of God, or other causes beyond the control of Rockford Silk Screen Process. In such cases, schedules will be extended by an amount of time equal to delay incurred. Any jobs requesting expediting or rush status are subject to rush charges.

Customer-Furnished Materials

Materials furnished by customers or their suppliers are verified by delivery acceptance. Rockford Silk Screen Process bears no responsibility for discrepancies between delivery tickets and actual counts. Customer supplied stock will be verified and inspected upon receipt.  Note that overs need to be supplied for setup and for manufacturing error and it is acceptable for Rockford Silk Screen to request additional setup for the manufacturing process.

Outside Purchases

Unless otherwise agreed in writing, all outside purchases as requested or authorized by the customer are chargeable.

Liability

Disclaimer of Express Warranties Provider warrants that the work is as described in the purchase order. The customer understands that all sketches, copy, dummies, and preparatory work shown to the customer are intended only to illustrate the general type and quality of the work. They are not intended to represent the actual work performed.

Disclaimer of Implied Warranties

Rockford Silk Screen Process warrants only that the work will conform to the description contained in the purchase order. Rockford Silk Screen Process’s maximum liability, whether by negligence, contract, or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will Rockford Silk Screen Process be liable for specific, individual, or consequential damages.

The Author or Person

Presenting job for print represents that he or she is the sole author of the Work and is the owner of the copyright to all of its contents; that he or she has not engaged in plagiarism and that the Work, if fiction, represents no real event or person(s) that could in any way be deemed libelous and that, if nonfiction, does not misstate or omit any fact which would libel any person(s) or result in a person(s) being placed in a false or damaging light; and that the Work does not infringe the copyright, trademark or privacy of any third party; and that he or she is owner of any trademarks and/or trade names associated with the Work; that the Work does not constitute obscenity or hate literature and that the author has the right to enter into this Agreement.

Indemnification

The customer agrees to protect Rockford Silk Screen Process from economic loss and any other harmful consequences that could arise in connection with the work. This means that the customer will hold Rockford Silk Screen Process harmless and save, indemnify, and otherwise defend him/her against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence.

Copyrights

The customer also warrants that the subject matter to be printed is not copyrighted by a third party. The customer also recognizes that because matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction. To support these warranties, the customer agrees to indemnify and hold Rockford Silk Screen Process harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provided.

Personal or Economic Rights

The customer also warrants that the work does not contain anything that is libelous or scandalous, or anything that threatens anyone’s right to privacy or other personal or economic rights. The customer will, at the customer’s sole expense, promptly and thoroughly defend Rockford Silk Screen Process in all legal actions on these grounds as long as Rockford Silk Screen Process: promptly notifies the customer of the legal action; and gives the customer reasonable time to undertake and conduct a defense. Rockford Silk Screen Process reserves the right to use his or her sole discretion in refusing to print anything he or she deems illegal, libelous, scandalous, improper, or infringing upon copyright law.

Storage

Rockford Silk Screen Process will retain intermediate materials as necessary and applicable. Rockford Silk Screen Process is not liable for any loss or damage to stored material beyond what is recoverable by Rockford Silk Screen Process’s fire and extended insurance coverage.

Returns

Due to the customized and print on demand manufacturing process of the product line. Items are non-refundable and non-returnable outside of material or product failure.  Photos and returned products may be requested to validate the return. Under no circumstance does Rockford Silk Screen reimburse (or provide credit) for return shipping costs incurred by the customer. If a product is damaged or defective, the recipient must make arrangements with Rockford Silk Screen support as to how the return should be handled prior to placing the items back in transit to Rockford Silk Screen. 

Warranty

Rockford Silk Screen will provide warranty information for all products honored by warranty.  Note that exceptions, misuse, environmental factors may influence warranty validity. All warranty guidelines will be provided at time of order.

 Taxes

All amounts due for taxes and assessment will be added to the customer’s invoice and are the responsibility of the customer. No tax exemption will be granted unless the customer’s Exemption Certificate (or other official proof of exception) accompanies the purchase order or has been previously provided. If, after the customer has paid the invoice, it is determined that more tax is due, then the customer must promptly remit the required taxes to the taxing authority, or immediately reimburse Rockford Silk Screen Process for any additional taxes paid.

Jurisdiction

The parties agree that all disputes arising under this agreement shall be governed by Illinois law. The parties further agree that the Courts of the State of Illinois shall be the sole and exclusive jurisdiction and venue in which any dispute arising under this agreement shall be determined.
